These Affiliate Terms and Conditions ("Terms") outline the terms governing your participation in the Evolvly Affiliate Program ("Program"). By signing up as an Affiliate, you agree to these Terms in full.

1. Enrollment in the Program

To enroll, you must opt-in to the Evolvly Affiliate program via written request or clicking on the provided affiliate program link.

Evolvly reserves the right to reject any request for any reason without explanation.

2. Affiliate Responsibilities

Affiliates agree to promote Evolvly CRM in an honest and ethical manner.

Affiliates may promote Evolvly via: Their website Email marketing campaigns Social media channels, including but not limited to Facebook groups and LinkedIn groups Podcasts, webinars, and live events

3. Affiliate Commissions

Tier 1: Affiliates will earn $50 per referral, paid in two equal installments of $25 each:

Tier 2: Affiliates will earn $100 per referral, paid in two equal installments of $50 each:

Payments: The first installment will be paid after the referred customer’s first successful payment. The second installment will be paid after the referred customer’s second successful payment.

If a referred customer cancels before the second payment, the second installment will not be paid. Commissions will be paid out on a monthly basis.

4. Affiliate Link Usage

Affiliates will be provided with a unique referral link to track sales.

It is the Affiliate’s responsibility to ensure their link is used correctly. Evolvly is not responsible for untracked referrals due to incorrect link usage.

5. Promotion Guidelines

Affiliates may not engage in misleading, unethical, or spammy marketing tactics to promote Evolvly.

Affiliates may not make false claims about Evolvly’s features, pricing, or services.

Affiliates are required to comply with all applicable laws and regulations, including FTC guidelines for affiliate marketing.

6. Brand Representation

Affiliates may not create social media accounts, websites, or marketing materials that impersonate Evolvly or imply official partnership without written permission.

Any promotional materials provided by Evolvly must be used as provided and cannot be altered without permission.

7. Termination

Either party may terminate this agreement with 30 days written notice.

Evolvly reserves the right to immediately terminate an Affiliate's participation if they are found to be in violation of these Terms.

Upon termination, any unpaid commissions will be paid within 30 days, except in cases of fraudulent activity.

8. Intellectual Property

Affiliates may use Evolvly’s logos, marketing materials, and branding only in accordance with these Terms and with Evolvly’s approval.

9. Confidentiality

Any non-public information shared between the parties must remain confidential during and after participation in the Program.

10. Indemnification

Affiliates agree to indemnify and hold harmless Evolvly from any claims, damages, or losses resulting from their marketing efforts or violations of these Terms.

11. Modifications

Evolvly reserves the right to update these Terms at any time. Affiliates will be notified of material changes and may terminate their participation if they disagree with the changes.

12. Governing Law

These Terms shall be governed by the laws of the State of Arizona.

By participating in the Evolvly Affiliate Program, you acknowledge that you have read, understood, and agreed to these Terms.
